An application for judicial review by the Christian Institute and others [2007] NIQB 66; [2008] IRLR 36 | Practical Law

In An application for judicial review by the Christian Institute and others [2007] NIQB 66, a number of Christian groups mounted a challenge to the Equality Act (Sexual Orientation) Regulations (Northern Ireland) 2006, which prohibit direct and indirect discrimination and harassment on the ground of sexual orientation in the field of goods and services, premises management, education and public functions. They were successful in quashing the provisions on harassment. However, the court rejected a challenge that the Regulations were incompatible with the European Convention on Human Rights on the basis that they interfered with the manifestation of religious beliefs contrary to article 9 of the ECHR.
