In Keiller v Information Commissioner (EA/2011/0152), The First-tier Tribunal (Information Rights) found that a copy of an e-mail held on a back up server was held for the purposes of regulation 12(4)(a) of the Environmental Information Regulations (SI 2004/3391), even though the original copy of the e-mail had been deleted by its sender from his computer.
