Market abuse: overview (pre-MAR regime)

Law stated as at 02 Jul 2016United Kingdom
Please note the law stated date of this practice note, which is no longer maintained.
The contents of this note reflect the former UK market abuse regime that was in force until 3 July 2016, when the Market Abuse Regulation (Regulation 596/2014) (MAR) took effect across the EU. MAR repealed and replaced the Market Abuse Directive (2003/6/EC) (MAD) and its implementing legislation on this date. UK implementation of MAR's provisions required changes to the former UK market abuse regime, which was largely derived from MAD. As a result, this note and related notes on aspects of the pre-MAR UK market abuse regime are being retained for reference and comparison purposes, but have been law stated as at 2 July 2016.
For details of Practical Law’s MAR content, including practice notes on the current UK market abuse regime, see Practice note, MAR: Practical Law resources.
This practice note provides an overview of the UK civil market abuse regime under sections 118 and 118A of the Financial Services and Markets Act 2000 (FSMA), supplemented by the FCA's Code of Market Conduct.
