Illinois recently enacted SB2306, which amends The Right to Privacy in the Workplace Act, the state's year-old social media law, by clarifying that the law applies only to the personal accounts of employees and not to professional accounts used for business purposes. This amendment becomes effective January 1, 2014.
On August 16, 2013, Illinois Governor Pat Quinn signed into law SB2306, an amendment to the state's year-old social media law, The Right to Privacy in the Workplace Act. The amendment clarifies that the Act applies only to the personal accounts of employees or prospective employees used exclusively for personal communications unrelated to any business purpose of the employer, and not to professional accounts used for business purposes. The amendment also adds an exception that other states have included in their social media laws that nothing restricts an employer from complying with legal duties to screen employees or applicants prior to hiring or to monitor or retain employee communications as required by law provided that the information sought by the employer relates to a professional account. The amendment becomes effective January 1, 2014.
