The Wage and Hour Division (WHD) of the Department of Labor (DOL) has entered into an agreement with the Consulate General of Mexico in El Paso, Texas to educate Mexican nationals in Texas and New Mexico about their rights as employees under federal law, regardless of their immigration status.
On February 18, 2014, the Wage and Hour Division (WHD) of the DOL announced it will sign an agreement on February 19, 2014 with the Consulate General of Mexico in El Paso, Texas to collaborate on educating Mexican nationals in Texas and New Mexico about their rights as employees under federal law, regardless of their immigration status.
The terms of the agreement state that the parties will collaborate to educate about employee rights and employer obligations under:
  • The FLSA.
  • The Migrant and Seasonal Agricultural Worker Protection Act.
  • The H-2A and H-2B programs under the Immigration and Nationality Act.
The agreement also states that the parties will provide resources and train Mexican nationals on exercising their rights under these US laws, to reduce and prevent violations of:
  • Minimum wage.
  • Overtime.
  • Record keeping.
  • Child labor.
  • Safe housing and transportation provisions of the laws and regulations enforced by the WHD.
This agreement follows a similar agreement between the Mexican Foreign Ministry and the National Labor Relations Board (NLRB) (see Legal Update, NLRB Signs Letter of Agreement with Mexican Foreign Ministry).
