Jackson Lewis: Nevada's Medical Marijuana Law Goes into Effect on April 1, 2014 | Practical Law

This Law Firm Publication by Jackson Lewis, P.C. discusses Nevada's medical marijuana law, SB 374, effective April 1, 2014. The law expressly states that employers are not required to allow for the medical use of marijuana in the workplace. They are also not required to modify the job or working conditions of employees engaging in medical marijuana use based on the reasonable business purposes of the employer. However, employers must attempt to reasonably accommodate the medical needs of these employees if the employees hold valid registry identification cards and an accommodation neither poses a threat of harm or danger to persons or property, imposes an undue hardship on the employer nor prevents employees from fulfilling their job duties.
