In Future New Developments Ltd v B&S Patente und Marken GmbH [2014] EWHC 1874 (IPEC), the Intellectual Property Enterprise Court considered whether the English court had jurisdiction over a claim against a German defendant on the basis of Article 24 of the Brussels Regulation, as the defendant had appeared in previous proceedings in the Intellectual Property Office (IPO). The judgment considers the meaning of "a court of a member state" and "entering an appearance", in the context of the Brussels Regulation.
