Stipulation of Dismissal Constitutes a Judgment under FRCP 60: Eighth Circuit | Practical Law

In White v. National Football League, the US Court of Appeals for the Eighth Circuit reversed the district court's finding that the plaintiffs could not seek to set aside a stipulation of dismissal under Federal Rule of Civil Procedure (FRCP) 60(b).  In so doing, the court joined six other circuit courts in holding that a stipulated dismissal constitutes a judgment under Rule 60(b).
