The US Copyright Office has issued a final rule amending regulations for the recordation of copyright transfers and other documents to improve the efficiency for processing certain types of documents submitted for recordation.
On September 17, 2014, the US Copyright Office issued a final rule amending its regulations for the recordation of copyright transfers and other documents (79 FR 55633-01). This final rule takes into account five comments the Copyright Office received in response to its July 16, 2014 notice of proposed rulemaking. The final rule makes the following changes to its proposed rules concerning the processing of electronic title lists:
  • Potential scenarios where discrepancies in the electronic list may raise concerns about notice or priority are omitted.
  • The Copyright Office will now add a note into the record indicating that it has used an electronic title list submitted by the remitter for purposes of indexing the document.
  • When registration numbers are listed in electronic title lists, remitting parties must use:
    • commas to separate the registration numbers when multiple registration numbers are associated with a title; and
    • all capital letters for the alphabetic prefixes of registration numbers (for example, "VAU" not "VAu").
This rule will take effect on October 17, 2014.
