CAFA State Action Exception Only Applies Where All Primary Defendants are State Entities: Tenth Circuit | Practical Law

In Woods v. Standard Insurance Co., the US Court of Appeals for the Tenth Circuit held that the state action exception to the Class Action Fairness Act (CAFA), which excludes from federal jurisdiction cases in which the primary defendants are states, requires all primary defendants to be state entities.
