Foley Hoag: Massachusetts Maternity Leave Act Expands with New Parental Leave Law | Practical Law

This Law Firm Publication by Foley Hoag LLP discusses the Parental Leave bill, signed into law on January 7, 2015. The new law expands the Massachusetts Maternity Leave Act, and now offers to men the eight-week job-protected leave, previously available only to women. In addition, an employee may take leave if a child is placed in custody with that employee by court order. Finally, the law creates a presumption that the employer's requirement to restore an employee to her previous or a similar position following parental leave includes leave exceeding eight weeks, unless the employer tells the employee in writing that she will not be reinstated if her leave exceeds eight weeks. The Parental Leave bill takes effect on April 7, 2015.
