Jackson Lewis: Pennsylvania Enacts Medical Marijuana Law | Practical Law

This Law Firm Publication by Jackson Lewis P.C. discusses Pennsylvania Governor Tom Wolf's signing of The Medical Marijuana Act, which permits marijuana use for medicinal purposes by patients suffering from a wide array of conditions ranging from nerve damage to cancer. The new law specifies the forms by which the marijuana may be dispensed. While the law becomes effective 30 days after Wolf's April 17, 2016 signing, the program is expected to take 18 to 24 months to implement, due to necessary Department of Health processes, including the creation of rules and regulations for establishing and operating marijuana dispensaries. Pennsylvania employers may not discriminate against an employee on the basis of his medical marijuana use. However, the law does not require employers to accommodate the employee's marijuana use at work, and places some restrictions on employees in safety-sensitive jobs when they are under the influence of medical marijuana.
