This Law Firm Publication by Jackson Lewis P.C. discusses the expansion of the Maryland Equal Pay Law to prohibit employers from paying lesser wages or providing lesser opportunities based on an employee's gender identity. Employers are still permitted to base variations in pay or opportunity on non-discriminatory reasons, such as seniority, experience, and education. The law, signed by Governor Larry Hogan on May 19, 2016, also limits an employer's ability to prevent workers from discussing or inquiring about pay, as Maryland joins a growing list of states with their own pay transparency laws. The expansions to the Maryland Equal Pay Law become effective on October 1, 2016.
