The Court of Appeal has upheld the High Court decision (on broadly the same grounds) that the Leonard Cheshire Foundation is not a public authority and that its provision of residential accommodation to disabled persons, the fees for whom were paid by the local authoirity, was a private act for the purposes of the Human Rights Act 1998.
