National minimum wage

A note on the national minimum wage covering who is entitled to the NMW, how to determine whether the NMW has been paid, including what does and does not count towards NMW pay, and how working time is measured for the purposes of the NMW. The note also deals with the penalties for failure to pay the NMW and the remedies available to workers who have not been paid the NMW.

This practice note refers to the National Minimum Wage Regulations 2015 (SI 2015/621) which came into force on 6 April 2015, replacing the National Minimum Wage Regulations 1999 (SI 1999/584) (NMW Regulations 1999). For destination tables showing the destination of the NMW Regulations 1999 in the new regulations, see Checklist, National Minimum Wage Regulations 2015: destination tables.
