Statement of Truth
Following an amendment, PD 22.2.1 states that a statement of truth in various specified documents should say:
"[I believe] [the (claimant or as may be) believes] that the facts stated in this [name document being verified] are true. [I understand] [The (claimant or as may be) understands] that proceedings for contempt of court may be brought against anyone who makes, or causes to be made, a false statement in a document verified by a statement of truth without an honest belief in its truth."
CPR 22.1 specifies that an acknowledgment of service in a claim begun by the Part 8 procedure should contain a statement of truth. However, the requirement in PD 22.2.1 for the amended wording stated above does not appear to apply to a Form N15, because that form is not a type of document listed at PD 22.2.1. It is unclear whether it makes any difference if the completed Form N15 contains evidence of fact upon which the defendant wishes to rely, or if the defendant intends to contest the claim and sets out brief details of any different remedy they are seeking. HMCTS has not updated Form N15 to include the amended wording at PD 22.2.1 and HMCTS has not yet clarified whether the amended wording should be used in any circumstances. Note that, if a witness statement is filed with the Form N15, that witness statement should contain a statement of truth in the expanded form indicated at PD 22.2.2.
The person signing the statement of truth must sign and print their name under the signature (PD 22.3.8), and the statement of truth must also be dated with the date on which it is signed (PD 22.2.7).
