FTC issues advisory opinion recommending no challenge to physician-hospital organisation | Practical Law

On 14 April 2009, the US Federal Trade Commission (FTC) announced that it has no plans to challenge a proposed programme by physician-hospital group TriState Health Partners (TriState) that would integrate and co-ordinate medical care services by TriState's physician members and a local hospital. TriState, located in Maryland, sought an advisory opinion from the FTC regarding the competition implications of its proposed clinical integration programme prior to its launch. Under the advisory process, the FTC staff reviews proposed conduct and issues an opinion on whether it would recommend that the FTC challenge that behaviour.
