Service in the Uniformed Services
Under the Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), this includes the voluntary or involuntary performance of duty in the uniformed services, including any of the following:
- Active duty.
- Active duty for training.
- Initial active duty for training (the initial duty for training performed by recruits).
- Inactive duty training (authorized training performed by a Reserve member not on active duty or active duty for training).
- Full-time National Guard duty.
- Submitting to an examination to determine an individual's fitness for any of these services.
- Funeral honors duty performed by National Guard or certain Reserve members.
- Duty performed by intermittent disaster response personnel for the Public Health Service and approved training to prepare for this service.
It also includes service as an intermittent disaster response appointee of the National Disaster Medical System when participants are either:
- Activated under federal authority.
- Attending authorized training in support of their federal mission.
Full-time, part-time, and probationary employees absent from work because of service in the uniformed services generally are covered by USERRA's military leave and reemployment provisions. For more information, see Practice Note, Military Leave Law.
