The US Citizenship and Immigration Services (USCIS) announced that it will begin accepting H-1B petitions toward the 2013 Fiscal Year (FY) cap on April 2, 2012. The number of H-1B petitions for FY 2013 is capped by Congress at 65,000, subject to several exemptions.
On March 27, 2012, the US Citizenship and Immigration Services (USCIS) announced it will accept H-1B petitions toward the 2013 Fiscal Year (FY) cap starting on April 2, 2012.
FY 2013 H-1B petitions are capped by Congress at 65,000, plus 20,000 additional H-1Bs for US master's degree or higher graduates. Exemptions from this limitation are available for:
  • Higher education institutions or affiliated nonprofit entities.
  • Nonprofit and governmental research organizations.
  • Workers in Guam or the Commonwealth of the Northern Mariana Islands.
  • Workers previously granted H-1B status and counted against prior H-1B caps.
