On July 12, 2012, the International Trade Commission (ITC) issued proposed amendments to its Rules of Practice and Procedure concerning Section 337 Investigations.
The International Trade Commission recently issued a notice of proposed rulemaking concerning proposed amendments to its Rules of Practice and Procedure. The ITC's goal is to increase the efficiency of Section 337 intellectual property rights investigations. The amendments address Title 19, Parts 201 and 210 of the Code of Federal Regulations and concern:
  • Initiation and conduct of investigations.
  • Determinations and actions taken.
  • Definitions for certain terms used in Part 210.
  • Requirements for written submissions.
  • The special treatment of confidential business information in Section 337 investigations.
  • The computation of time in Section 337 investigations.
  • Pleadings and motions.
  • Discovery and compulsory process.
  • Temporary relief.
  • Enforcement proceedings and advisory opinions.
Written comments must be received by 5:15 p.m. on September 10, 2012.
