This Legal Update reports on changes to the local rules and Case Management/Electronic Case Filing (CM/ECF) rules for all US federal district and appellate courts between December 12 and 18, 2012. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

District of Massachusetts

The US District Court for the District of Massachusetts updated its fee schedule, effective December 13, 2012. Copying CM/ECF documents is now $0.10 per page, copying or reproducing any non-electronic record or paper is now $0.50 per page and copying non-case material from the court website is now $0.50 per page.

Northern District of New York

The US District Court for the Northern District of New York announced new local rules, effective January 1, 2013.

Southern District of New York

Magistrate Judge Frank Maas updated two of his court documents. Judge Maas's:
  • Individual Rules of Practice now require that courtesy copies of all motion papers be submitted to chambers within one day of electronic filing and that the courtesy copies must be bound on the left side with protruding tabs for exhibits.
  • Order of Discontinuance now contains the following language: "ORDERED that said action be and hereby is, discontinued with prejudice and without costs."

Northern District of Ohio

The US District Court for the Northern District of Ohio announced changes to its fee schedule, effective January 1, 2013. The admission to practice fee will increase from $216 to $225, and the admission to practice pro hac vice fee will increase from $100 to $120.

Central District of California

Judge Stephen V. Wilson updated his policy on Mandatory Chambers Copies of E-Filed Documents to reflect that mandatory chambers copies of any electronically filed document that contains a proposed order must be delivered to chambers no later than noon on the following business day. When a proposed order accompanies a filing, a WordPerfect or Word copy of the proposed order, with a PDF copy of the electronically filed document, must be e-mailed to the chambers e-mail address.

Western District of Washington

The US District Court for the Western District of Washington posted a model agreement regarding discovery of electronically stored information (ESI). The model agreement is intended as a framework to address ESI issues and it covers the basic provisions that the court expects will apply in most cases.
