This Legal Update reports on significant changes to the local rules and procedures for all US federal district and appellate courts between April 3 and April 9, 2013. It also reports on changes to the individual practice rules for judges in select district courts during this time period.

Administrative Fee

Effective May 1, 2013, pursuant to Judicial Conference Policy, all federal district courts will begin charging a $50 administrative fee for filing a civil action, suit or proceeding in a district court, in addition to the $350 filing fee. The administrative fee does not apply to persons granted in forma pauperis status under 28 U.S.C. § 1915. Several courts have announced this change, and an example of the announcement can be read here.

Federal Circuit

Federal Circuit Court of Appeals

The US Court of Appeals for the Federal Circuit posted a Notice to Counsel on Oral Argument. The court also added a Certificate of Service.

First Circuit

District of Maine

The court updated its guidelines for posting confidential information in civil cases.

District of Massachusetts

The US District Court for the District of Massachusetts updated its attorney handbook. The previous attorney handbook can be viewed here.

Second Circuit

Eastern District of New York

The US District Court for the Eastern District of New York adopted new local patent rules, effective April 8, 2013.

Southern District of New York

The US District Court for the Southern District of New York adopted new local patent rules, effective April 8, 2013.

Third Circuit

District of New Jersey

Judge Esther Salas now requires that all correspondences and proposed orders must be submitted through ECF. If extensions of time are consented to, this may be done via consent order and must be submitted via ECF. Judge Salas's page can be viewed here.

Western District of Pennsylvania

Judge Arthur J. Schwab added a new Case Management Order.

District of the Virgin Islands

The US District Court of the Virgin Islands updated its Schedule of Court Fees, effective April 1, 2013.

Fourth Circuit

The US Court of Appeals for the Fourth Circuit posted a Notice of Amendments to Local Rules 36(b) and 46(c).
The court also posted new Electronic Appendix Instructions.

Fifth Circuit

Southern District of Texas

The US District Court for the Southern District of Texas posted a new general order regarding admission of attorneys and electronic filing registration.

Sixth Circuit

Northern District of Ohio

Senior Judge Lesley Wells posted a new general order.

Eastern District of Tennessee

The US District Court for the Eastern District of Tennessee posted new Garnishment and Execution Instructions and a new Motion for Order to Disburse Garnished Funds.

Seventh Circuit

Southern District of Illinois

Judge G. Patrick Murphy updated his Case Management Procedures. Proposed orders, jury instructions and other documents for which leave is sought to be filed must be e-mailed to the court. The subject line of the e-mail must include the case name, the case number, the corresponding document number and a brief description of the proposed document. Proposed documents, except for settlement statements (which are submitted ex parte to the magistrate judge), should also be served on all parties.
Judge Michael J. Reagan updated his Case Management Procedures with the following:
  • Trial briefs are not required. If filed, they are due 14 calendar days before the Final Pretrial Conference.
  • Exhibit lists should be e-mailed to the courtroom deputy in Word format if possible.
Senior Judge William D. Stiehl changed his Case Management Procedures. He now requires that proposed jury instructions be provided in Word format.
Magistrate Judge Clifford J. Proud changed his Case Management Procedures as well, also to require that proposed jury instructions be provided in Word format.

Northern District of California

Southern District of California

Magistrate Judge William V. Gallo revised his chamber rules.

District of Oregon

The US District Court for the District of Oregon posted a Statement of Professionalism and Notice of Rule 83-6.

Eleventh Circuit

Middle District of Florida

The US District Court for the Middle District of Florida revised its list of certified mediators.
