The International Trade Commission (ITC) has issued a final rule amending its Rules of Practice and Procedure relating to procedures in Section 337 investigations.
On April 15, 2013, the International Trade Commission (ITC) issued final rules amending its Rules of Practice and Procedure. The ITC states the amendments are necessary to:
  • Make certain technical amendments.
  • Clarify certain provisions.
  • Harmonize different parts of the Commission's rules.
  • Address concerns that have arisen in Commission practices.
While the majority of the rules in the final rules are unchanged from those proposed by the ITC on July 12, 2012, nine of the final rules differ from their proposed versions. These changes from the proposed rules are summarized in the overview of the document. For more information on the proposed rules, see Legal Update, Section 337 Investigations: ITC Proposes Changes to Rules of Practice and Procedure.
The rules will become effective on May 20, 2013.
