This note sets out the law relating to the recovery of costs of litigation incurred by in-house lawyers from opponents in civil litigation. In principle, these costs are recoverable. However, some specific considerations arise. This note addresses these considerations, with a view to providing guidance to those seeking to make, or resist, these costs claims.
