This Legal Update reports on significant changes to the local rules and procedures for all US federal district courts and appellate courts between September 17 and 23, 2014. It also reports on changes to the individual practice rules for the judges in select district courts during this period.

Administrative Office of the US Courts

The Administrative Office of the US Courts announced that, by the end of October 2014, it is restoring public access to years of court records that were removed from PACER's online archives in August from the following five courts:
  • US Court of Appeals for the Second Circuit, for cases filed prior to January 1, 2010.
  • US Court of Appeals for the Seventh Circuit, for cases filed prior to January 1, 2008.
  • US Court of Appeals for the Eleventh Circuit, for cases filed prior to January 1, 2010.
  • US Court of Appeals for the Federal Circuit, for cases filed prior to March 1, 2012.
  • US Bankruptcy Court for the Central District of California, for cases filed prior to May 1, 2001.

Second Circuit

Eastern District of New York

The US District Court for the Eastern District of New York approved amendments to Division of Business Rule 50.1(e), Miscellaneous Cases, and Rule 50.5, Miscellaneous Judge and Duty Magistrate Judge, which take effect immediately.

Southern District of New York

Judge Katherine B. Forrest updated her individual rules of practice in civil cases. A copy of the previous version is available here.

Third Circuit

District of Delaware

Magistrate Judge Christopher J. Burke updated his order governing mediation conferences and mediation statements. A copy of the previous version is available here.

Fourth Circuit Court of Appeals

The US Court of Appeals for the Fourth Circuit updated its Brief and Appendix Requirements. A copy of the previous version is available here.

Fifth Circuit Court of Appeals

The US Court of Appeals for the Fifth Circuit announced that effective September 24, 2014, the Clerk's Office will no longer provide change to paying customers. Exact change will be required if you choose to pay with cash.

Southern District of Texas

The US District Court for the Southern District of Texas adopted changes to its motion and order for admission pro hac vice form.

Western District of Kentucky

The US District Court for the Western District of Kentucky:

Southern District of Ohio

The US District Court for the Southern District of Ohio, Western Division issued a general order of assignment and reference.

Seventh Circuit

Northern District of Illinois

Judge Joan B. Gottschall updated her case management packet. A copy of the previous version is available here.

Eighth Circuit

Western District of Arkansas

The US District Court for the Western District of Arkansas:
  • Announced that effective September 22, 2014, it will accept online payments through the US Treasury's Pay.gov application for pro hac vice motions and notices of appeal.
  • Updated its instructions for motions for leave to appear pro hac vice, to reflect that the motion can now be electronically filed and that the fee can be paid using the newly-implemented Pay.gov application.
  • Issued a general order providing limited authority to the clerk of court to refund fees that are erroneously paid using the newly-implemented Pay.gov application.

District of Minnesota

The US District Court for the District of Minnesota posted new rates of juror subsistence payments for individuals from various parts of the state, for the period spanning October 1, 2014 through September, 30, 2015:
  • Minneapolis: $206.00.
  • St. Paul: $206.00.
  • Duluth:
    • $153.00 per day from October 1, 2014 to June 30, 2015;
    • $181.00 per day from July 1, 2015 to August 31, 2015;
    • $153.00 per day from September 1, 2015 to September 30, 2015.
  • Fergus Falls: $129.00.
  • Rochester: $173.00.
  • Dakota County: $155.00.
  • All other areas of the state: $129.00.

District of North Dakota

Ninth Circuit

Central District of California

Judge Patrick J. Walsh updated his stipulated protective order. A copy of the previous version can be found here.
Judge Consuelo B. Marshall updated her procedures and schedules, adding a section for procedures for filing protected material.
Magistrate Judge Jay C. Gandhi updated the settlement conferences and stipulated protective orders sections of his procedures and schedules.

District of Idaho
