This article looks at a recent decision of the Turkish Competition Board, which pursued an improper approach in applying Article 9(3) of the Turkish Competition Law. The article critically analyses the decision in detail and looks at how misapplication of competition rules and the imposition of fines for hypothetical breaches can prevent new market entrants as well as distort competition.
