The EAT suggested that, at an early stage in discrimination proceedings, it may be helpful for the tribunal to determine (whether by agreement with the parties or otherwise) the issues of fact that will be relevant to whether the claimant can establish a prima facie case, thereby satisfying stage one in the two-stage approach to the burden of proof in discrimination cases.
