Drafting third party rights to include in a bespoke construction document, using the Contracts (Rights of Third Parties) Act 1999 (Third Party Rights Act 1999), requires a different drafting approach compared to drafting collateral warranties. This note considers some of the practical aspects of that approach and ways of avoiding some of the pitfalls of using the Third Party Rights Act 1999.
