Notice of Appeal

A court document filed by the appellant, which places the court and the other parties on notice of the appellant's intent to take an appeal from an order or judgment. The appellant typically files a notice of appeal with the trial court, not the appellate court.
A notice of appeal typically:
  • Specifies the party or parties taking the appeal by naming each one in the caption or body of the notice.
  • Designates the judgment or order, or portion of either, being appealed.
  • Names the court to which the appeal is taken.
In some courts, if an order or judgment is not appealable as of right, the party aggrieved by that order or judgment must file a petition for permission to appeal instead of a notice of appeal.
