In Walter Llewellyn & Sons Ltd and another v Excel Brickwork Ltd [2010] EWHC 3415 (TCC), Akenhead J held that the parties' sub-contract did not incorporate an arbitration agreement. As such, the court proceedings were not stayed to arbitration under section 9 of the Arbitration Act 1996.
