This Jackson Lewis LLP memorandum discusses the substantial revisions to the Oklahoma Standards For Workplace Drug and Alcohol Testing Act (Okla. Stat. §§ 551 - 563). The revisions, which became effective on November 1, 2011, simplify the law and make it more employer-friendly. The revisions include reductions in written policy requirements and in the required notice period, and a replacement of the "reasonable suspicion" test with a "for cause" test based on a "reasonable belief" standard for employers. The revised law also permits testing of independent contractors under certain circumstances.
