Energy Policy Act of 1992 (EPAct 1992)
A federal law that aims to reduce US dependence on imported oil and improve air quality by addressing all aspects of the US energy supply and demand, including alternative fuels, renewable energy and energy efficiency (Pub. Law 106-486). Among other things, it:
- Requires the Federal Energy Regulatory Commission to implement regulations opening the US electric grid by requiring utilities to provide access to their transmission facilities to non-utility power producers on a non-discriminatory and non-preferential basis.
- Established the production tax credit and investment tax credit for certain renewable technologies.
- Created a new class of generators, the exempt wholesale generator, that is exempt from the provisions of the Public Utilities Holding Company Act of 1935, and following its repeal under the Energy Policy Act of 2005, the provisions of Public Utility Holding Company Act of 2005.
- Encourages the use of alternative fuels through the Department of Energy's regulatory and voluntary activities.
