Decision of South Tyneside Council relating to care home fees quashed by High Court | Practical Law

On 28 June 2013, the High Court in R (South Tyneside Care Home Owners Association and others) v South Tyneside Council [2013] EWHC 1827 (Admin) quashed the decision of South Tyneside Council as to the amount of  fees that it would pay to care homes in which it placed elderly and/or disabled residents. It did so on the basis that the decision was unlawful, procedurally unfair and/or Wednesbury unreasonable.
