Standard of Care

In the construction context, the manner in which a design professional must perform its professional services to avoid being found negligent for a design error or omission.
The applicable standard of care is customarily defined in the owner-designer contract. It usually requires the design professional to perform its services with the level of skill and care ordinarily used by a design professional that is:
  • Performing services of a similar nature.
  • On a similar type of project.
  • In that same location.
Contractual language seeking to hold the design professional to something greater than a negligence standard of care may potentially void the design professional's insurance coverage.
