Constangy: Georgia Law Penalizes Employers Unresponsive to Unemployment Claims | Practical Law

This Law Firm Publication by Constangy, Brooks & Smith, LLP discusses a Georgia rule that penalizes employers that do not timely and adequately respond to three or more individual unemployment insurance claims within the current calendar year. Those employers will have their account with the Georgia Department of Labor charged, regardless of whether the claim is later reversed on appeal or if an overpayment is established. The rule makes an exception for an employer who had "substantial good cause" for failure to timely and adequately respond. Georgia implemented this new rule to comply with the Unemployment Insurance Integrity Act, part of the Trade Adjustment Assistance Extension Act of 2011 (TAAEA), which requires states to ensure prompt and complete employer response to unemployment insurance claims.
