The US Patent and Trademark Office (USPTO) has issued a new Geographic Certification Marks Examination Guide after receiving public comments to a July 2013 draft guide.
On July 9, 2014, the USPTO released the Geographic Certification Marks Examination Guide 2-14, a new guide for examining geographic certification marks. The USPTO solicited public comments on the draft version last year. For more information on the draft version, see Legal Update, USPTO Seeks Comments on Draft of Examination Guide: Geographic Certification Marks.
The new guide:
  • Describes the application requirements for geographic certification marks.
  • Explains the analysis for determining whether a mark functions to certify regional origin.
  • Discusses the relevant considerations for Section 2(d) likelihood of confusion determinations involving geographic certification marks.
  • Provides examples.
The guide is available on the USPTO website.
