Jackson Lewis: Illinois’ Cook County Ordinance Restricts Credit History Use | Practical Law
This Law Firm Publication by Jackson Lewis P.C. discusses a recent amendment to the Human Rights Ordinance in Cook County, Illinois (which includes the City of Chicago) adding credit history as an item that employers may not consider in making hiring and personnel decisions. The amendment prohibits employers from using an applicant or employee's credit history when making decisions involving recruitment, discipline, compensation and termination. Employers in Cook County also may not inquire about an applicant or employee's credit history or obtain credit history reports pertaining to employees and applicants. The amendment exempts certain types of Cook County employers and provides for several exceptions including for jobs involving oversight of significant cash assets and for certain managerial positions.
