The US Patent and Trademark Office (USPTO) has issued a final rule amending the rules related to collective trademarks, collective service marks, collective membership marks, and certification marks.
On June 10, 2015, the USPTO issued a final rule amending the rules relating to collective trademarks, collective service marks, collective membership marks, and certification marks. The amended rules codify current USPTO practice set out in the Trademark Manual of Examination Procedure (TMEP) and case law, and clarifies:
  • Application requirements.
  • Allegations of use requirements.
  • Multiple-class application requirements.
  • Registration requirements.
The changes allow the USPTO to:
  • Provide the public with more detailed guidance about registering and maintaining registrations for these types of marks.
  • Promote their efficient and consistent processing.
The rule is effective as of July 11, 2015.
