The Cour Commune de Justice et d'Arbitrage (CCJA) (the court created by the OHADA Treaty) recently considered an application to set-aside an arbitral award on the grounds, amongst other things, that the tribunal had not fulfilled its mandate and had breached CCJA provisions by entering into a private fee agreement with the parties.
