This Practice note considers the wide-ranging powers of the European Commission under Articles 107 to109 of the Treaty on the Functioning of the European Union (TFEU) to investigate illegally paid subsidies and to order member state governments to recover subsidies that distort the market in favour of state-aided enterprises.
