The Credit Institutions (Reorganisation and Winding Up) Regulations 2004

This note outlines the provisions of The Credit Institutions (Reorganisation and Winding Up) Regulations 2004 (SI 2004/1045), and considers them in the context of European Parliament and Council Directive (2001/24/EC) on the reorganisation and winding up of credit institutions.

This note is being amended to reflect changes coming into force on 10 January 2015 made by the Bank Recovery and Resolution (No 2) Order 2014 (SI 2014/3348), which is one of the statutory instruments implementing the Bank Recovery and Resolution Directive (2014/59/EU) (BRRD): amendments made to the Credit Institutions(Reorganisation and Winding Up) Regulations 2004 extend the ambit of those regulations to investment firms and other entites in respect of which stabilisation measures are made under the BRRD or resulting UK legislation.
