This practice note sets out some of the questions to raise with clients in relation to the nature, types and sources of their documents, when preparing to undertake a disclosure exercise in the context of civil litigation.
It is relevant to disclosure exercises being conducted under the disclosure regime in CPR Part 31, Practice Direction (PD) 31A and 31B and under the separate regime in PD 57AD ("Disclosure in the Business and Property Courts"), which, since 1 October 2022, has applied in most cases in the Business and Property Courts, as the permanent incorporation of the Disclosure Pilot Scheme.
