The Channel Tunnel Group Ltd and France-Manche SA (the claimants) have received a favourable decision in their arbitration against the British and French governments. Proceedings were brought after considerable losses were incurred as a result of disruption and security expenses which arose when asylum-seekers at the Sangatte camp attempted to smuggle themselves aboard trains bound for the UK. The Tribunal (Lord Millett dissenting in part) found that Britain and France had failed to comply with their obligations under the Concession Agreement which governs operation of the channel tunnel link.
