Stone (R00465): exercise of discretion: trustees had not obtained sufficient information on distribution of death benefits | Practical Law

The Deputy Ombudsman has upheld a complaint brought by Mrs M Stone against Ford Pension Fund Trustees Ltd. She complained that the trustees did not properly consider all relevant circumstances before splitting death-in-service benefits between her and her deceased husband's child by a previous relationship. The Deputy Ombudsman referred the decision back to the trustees for reconsideration because they had not obtained or weighed sufficient information to reach a decision properly. He also directed that they give full reasons for their decision, which they had previously failed to do.
