FTC settles charges against Barr Laboratories regarding payments to delay entry of generic drug | Practical Law

On 29 November 2007, the US Federal Trade Commission (FTC) announced that it had entered a final order settling its charges that Barr Laboratories (Barr) violated US federal antitrust laws by agreeing to delay entry of a generic version of the Ovcon birth control in exchange for monetary payments from Warner Chilcott. Under the terms of the order, Barr is prohibited from entering into any supply agreements with similar terms to its agreement with Warner Chilcott or entering into any agreements with other pharmaceutical manufacturers that have the potential to harm competition.
