Substantive Arbitrability
The issue of whether a particular dispute is within the scope of the parties' arbitration agreement or clause and therefore is subject to arbitration. A court usually determines the issue, but under certain circumstances the arbitrator decides the issue. For information on arbitrability in the class action arbitration context, see Practice Note, Judicial or Arbitral Determination of Class Arbitrability Case Tracker.
