Bulgarian Competition Authority issues guidelines regarding rebates in-kind | Practical Law

On 11 November 2010, the Bulgarian Commission for the Protection of Competition (CPC) issued specific guidelines aimed at ensuring compliance with national competition laws of certain in-kind rebates (that is, non-cash rebates in the form of complementary goods or services) in vertical commercial transactions. The new guidelines complement the general guidelines for the interpretation and application of Article 36, paragraphs 2 and 3, of the Protection of Competition Act of 2009 (the Act) concerning certain types of prohibited, unfair competition such as offering to customers gifts or prizes that are related to/dependent on the purchase of the offeror’s products or services.
