The First-tier Tribunal (Information Rights), in a decision that has just been published, has upheld the Information Commissioner's decision that the Intellectual Property Office did not have to disclose legal advice provided to it on the basis of the legal professional privilege exemption from disclosure in section 42(1) of the Freedom of Information Act 2000. (Grace Szucs v Information Commissioner, EA/2011/0072, 16 August 2011.)
