UNCTAD publishes 2011 annual review of investment treaty cases

UNCTAD has released its 2011 annual review of investment treaty arbitration cases.
On 16 April 2012, UNCTAD published its annual review of developments in investment treaty arbitration cases during 2011. IIA Issues Note (No.1 April 2012), Latest developments in investor-State dispute settlement highlights the following:
- In 2011, 46 known investment treaty cases were filed under international investment agreements, the highest ever known in one year.
- The total of known investment treaty-based cases reached 450 in 2011.
- 89 countries have now responded to one or more investment treaty arbitrations.
The Issues Note also provides an overview of substantive and procedural issues addressed in the 2011 decisions, including the definition of "investment", the interpretation of Most Favoured Nation (MFN) clauses and the application of the fair and equitable treatment standard.
