A Practice Note discussing a lender's potential environmental liabilities in connection with a commercial real estate loan. This Note discusses the basic liability framework of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (CERCLA) and the defenses and protections available to lenders and owner-borrowers under the law. This Note also briefly discusses other state and federal laws that lenders should examine in assessing potential environmental liabilities.
